I said pretty much the exact same thing on Independence Day. It wasn't well-received.

Sorry sweetie, there are others out there who share your intense sense of frustration over this mess.

If I had a time machine, I would go back and warn them of these times. Benny Franklin knew it would end up this way, though, but no one would listen. :(

We survived the alien and sedition acts. We survived the Canadians burning down the White House. We survived (though were thoroughly damaged by) legal slavery. We survived a fantastically bloody and bitter civil war. We went from Lincoln to Teddy Roosevelt without a competent President. We survived Dred Scott. We got through the Great Depression. We beat back the world threat of fascism in the 1940's. We've made major progress since then on civil rights for blacks, women & people of varying sexual orientations (though lots of progress still to be made.) We survived Reagan. We survived the Contract with America.

And we will survive Bush. And we'll survive this one Law. Our courts will uphold the fourth amendment and toss this crap out. Maybe not the immunity part, but the warrantless searches for sure. The legislative branch can't just suddenly write their laws to be above the Constitution or Judicial Review. (See rulings on the Patriot Act and rights for Guantanimo prisoners, for example.)

I wish the legislature took Constitutionality as seriously as the courts do, but thank the founding fathers (and the Marbury decision) that we have checks and balances and specifically Judicial Review.

But yes, I think our founding fathers set up a system to deal with exactly this. I think they're beaming with pride because they foresaw times in our nation's future when we'd succumb to mass-panic and try to throw our rights down the outhouse, but the system would correct it and force calm and reason back into our policies.

The Constitution is a really beautifully crafted system. I wish more Americans understood it. I wish more Senators, Presidents, and Representatives appreciated it. And I wish Barack Obama in particular would stop listening to the "move to the right" power structure in the Democratic Party and go back to listening to his own conscience.
